Historical Note

In 1980, the United States Congress established the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA). In formally referred to as Superfund, this legislation empowers the Environmental Protection Agency to clean up sites contaminated from hazardous waste by industries such as mining, processing, manufacturing, and landfills. CERCLA mandates the parties responsible for contamination to pay for, or reimburse, the EPA for cleanup costs; if there is no responsible third party, CERCLA provides the cleanup funds to the EPA. In order for a contaminated site to be eligible for CERCLA, the EPA must evaluate it and place it on the National Priorities List. The Utah Superfund sites are part of the EPA Region 8, which is headquartered in Denver, in cooperation with the Utah Department of Environmental Quality (UDEQ) Division of Environmental Response and Remediation. As of 2020, the UDEQ oversaw 22 Superfund sites at various stages of remediation.
